As a landlord, renting out property is more than just collecting rent—it’s about fostering a fair, transparent, and professional relationship with your tenants. By incorporating just rental practices, you not only protect your investment but also create a positive renting experience that benefits both parties.

 

Understanding Your Legal Responsibilities

While Malaysia does not yet have a Residential Tenancy Act, existing laws provide a framework for fair rental practices:

 

  • Contracts Act 1950 – Ensures tenancy agreements are legally binding.

  • Civil Law Act 1956 – Governs claims related to unpaid rent.

  • Distress Act 1951 – Allows landlords to recover unpaid rent legally but prevents wrongful seizure of tenant belongings.

  • Specific Relief Act 1950 – Prohibits landlords from evicting tenants without a court order.

 

By understanding these laws, you can avoid legal disputes and build a reputation as a responsible landlord.

 

Best Practices for Fair Rentals

To maintain a smooth landlord-tenant relationship, consider the following:

 

  • Avoid listing racial preferences - Provide everyone regardless of race a fair chance at the opportunity to rent your property. 

  • Use a clear, written tenancy agreement – Outline rent, payment terms, security deposit conditions, and maintenance responsibilities.

  • Respect tenant privacy – Provide reasonable notice before inspections or repairs.

  • Handle security deposits fairly – Deductions should only cover damages beyond normal wear and tear.

  • Provide a safe and habitable property – Ensure the unit meets basic living standards.

  • Follow proper eviction procedures – If necessary, obtain a court order to legally remove a tenant.

 

Building Long-Term Rental Success

A fair rental system encourages trust and long-term tenancies, reducing vacancy rates and disputes. By incorporating just rental practices, you contribute to a more ethical and stable rental market in Malaysia.

 

When in doubt, always communicate openly with tenants and seek legal advice before taking any action. A fair landlord makes for a better rental experience—for everyone.
