1. What is MY Fair Rental?
MY Fair Rental is a campaign by Architects of Diversity Malaysia advocating for the Rental Tenancy Act-- a legislative policy that offers protection for landlords and tenants throughout the rental period. It represents a step towards achieving a unified, regulated rental market in Malaysia.
2. Why is a Rental Tenancy Act (RTA) necessary?
Currently, Malaysia lacks a comprehensive legal framework governing rental housing. This leads to inconsistent rental practices, disputes without clear resolution mechanisms, and financial insecurity for tenants and landlords alike. A Rental Tenancy Act would standardise rental agreements, introduce enforcement mechanisms, and create a balanced rental ecosystem.
3. What issues does the RTA address?
Our proposal of the RTA aims to address rental discrimination, unclear roles between landlords and tenants, and requires a rental tribunal to aid in dispute resolution, lightening the burden of landlords, as well as reducing unjust evictions.
4. How would the RTA benefit tenants and landlords?
For tenants, it ensures stronger security of tenure, and protection from exploitative practices such as rental discrimination and unjust evictions.
For landlords, it establishes a clear legal framework for tenancy agreements, reducing risks of non-payment, property damage and streamlining dispute resolution. A well-regulated rental market benefits all parties by fostering trust, transparency, and stability.
5. How does MY Fair Rental engage with policymakers?
We work with government agencies, policymakers, and legal experts to advocate for structured rental regulations. This includes conducting policy research, engaging in stakeholder discussions, and presenting evidence-based recommendations to support the introduction of a Rental Tenancy Act in Malaysia.
6. How can I show support for the RTA?
To show your support for the RTA, you can sign our petition on Change.org, write to your local MPs (check out our letter templates for landlords and tenants) to garner their support for the RTA and of course, by spreading the word!
7. Does Malaysia have any existing rental laws?
Currently, tenancy agreements are governed under contract law, but there is no dedicated Residential Tenancy Act to regulate rental terms, rental discrimination and dispute resolution. This leaves room for inconsistent practices and legal loopholes, underscoring the need for structured legislation.
